Why You Don’t Need to Worry About Paying an Attorney Upfront After an Accident

Two cars collide on a gravel road; one side and front are visibly damaged. The scene is set under a clear blue sky.

If you are in an accident and have sustained injuries, the last thing you want to think about is, “Can I afford an attorney to help me?”  That’s not something you need to worry about. All personal injury attorneys work on what is called a contingency fee.  That means we do not get paid unless we can secure a settlement for you, thereby allowing you to have legal representation without needing to pay upfront.

Out-of-Pocket Costs

When you hire a personal injury attorney, you will not incur any out-of-pocket costs for their services while they are litigating your case.  If you don’t win your case, your attorney does not get paid.  It costs you nothing.  If you do win, your attorney will receive a percentage of your total settlement. In New York, the maximum your attorney can receive from your settlement or court judgment is 33.3%.

The concept of a contingency fee arrangement works in the best interest of you and your attorney.  The ultimate goal for both of you is to secure the largest possible settlement.  The more your attorney recovers in damages, the more they get paid, and so do you.

Next Steps

If an attorney doesn’t think your case can be won, they most likely will not take it on, but the only way to know is to reach out to one and discuss your specific situation.

We are here to help you through the process if you or someone you know is involved in an accident. Our consultations are free, and we don’t receive payment unless you do.
