Been in an Accident with an Uninsured Motorist or Involved in a Hit-and-Run: The Law is On Your Side

If you have been in an accident in New York that involves an uninsured vehicle or a hit-and-run, the law is on your side. New York State provides several ways for coverage and compensation, even if the at-fault driver is uninsured or has left the scene of an accident.


No-Fault Coverage

New York is a “no-fault” state, meaning your own insurance policy typically is your first line of defense for recovery. Your Personal Injury Protection (PIP) coverage will pay for medical expenses, lost wages, and certain out-of-pocket costs—regardless of who caused the accident—up to the policy limit (usually $50,000). PIP is required in New York State and is included in your insurance policy.


Uninsured Motorist Coverage

Uninsured motorist coverage (UM) is also mandatory in New York State. This part of your insurance coverage becomes critical when the other driver involved in your accident is uninsured or has left the scene of the accident, in the case of a hit-and-run.


UM coverage can compensate you for:

  • Medical expenses beyond no-fault limits

  • Lost earnings

  • Pain and suffering (in qualifying cases)


What If You Don’t Have Insurance?

What happens if you are involved in an automobile accident, but don’t own your own vehicle or have an insurance policy?  In New York, you may have a safety net if you act quickly.  New York State created the Motor Vehicle Accident Indemnification Corporation (MVAIC) as a safety net for victims injured by uninsured or unidentified drivers.


MVAIC can provide compensation for medical bills and lost wages, but the requirements are very strict. For example, you must report the accident to the police within 24 hours and file a claim within specific deadlines.
