What Happens If I Am Involved in a Hit and Run in New York?

Being involved in a car accident is stressful enough, but when the other driver leaves the scene, the situation becomes even more complicated. If you or a loved one has been injured in a hit-and-run accident, it’s important that you understand your rights, how to protect yourself, and the legal options available to you.


How Does New York State Define a Hit-and-Run?


If you are in an accident, New York State law requires you to stay at the scene and exchange information with the other driver or drivers.  If a driver leaves the scene of an accident without doing these things, that is considered a hit-and-run. This applies to any accident involving another vehicle, person, cyclist, or property.  Leaving the scene of an accident can result in criminal charges.


What Should I Do If I Am Involved in A Hit-and-Run Accident?


If you are involved in a hit-and-run accident in New York, this is what you need to do immediately.

  1. Call 911. Report the accident as soon as it happens and request police assistance. A police report is critical in a hit-and-run case.

  2. Seek medical attention. Even if you think your injuries are minor getting checked will document any injury you may have. Additionally, not all injuries are immediately apparent.  You may start to experience pain or other symptoms a day or two after the accident, at which time you should see a doctor.

  3. Collect any evidence available. If possible, write down details about the vehicle that left the scene—such as color, make, model, license plate numbers, or any identifying features. Take photos of the scene and your damages.

  4. Find any witnesses and ask for their contact information.

  5. Let your insurance company know you were involved in a hit-and-run. Reporting the accident preserves your right to make an uninsured motorist (UM) claim.


How Does Insurance Work After a Hit-and-Run in New York


Because New York is a no-fault insurance state, your own insurance policy will cover your initial medical expenses and lost wages through Personal Injury Protection (PIP). PIP benefits are limited, though, and may not fully cover your losses.

If the driver of the vehicle that fled the scene cannot be found, you may be able to file an uninsured motorist claim under your own insurance policy to cover medical bills, lost wages, and pain and suffering.
